Beach Boys founder AL JARDINE has been given permission to pursue a lawsuit against his bandmates for breach of fiduciary duty.

Jardine has been at war with fellow Beach Boy MIKE LOVE since 1998, when Love sued Jardine to prevent him from touring under the group's name.

In addition, Love refused to pay Jardine for performances by the Beach Boys in which the singer wasn't allowed to take part.

But now California's Court of Appeal has declared Jardine is within his rights to fight Love and the other Beach Boys in court.
