The makers of Shia LaBeouf's thriller DISTURBIA are facing a second lawsuit over claims the movie is based on the classic story Rear Window.
A judge recently dismissed a suit which alleged movie bosses stole part of the film's plot from Cornell Woolrich's short story, which was turned into an Oscar-nominated film by Alfred Hitchcock in 1954.
And now, just weeks after the copyright infringement suit was wrapped up, the executors of The Sheldon Abend Revocable Trust have filed a new lawsuit in a bid to revive the legal battle.
The trust filed the breach-of-contract claim in Los Angeles Superior Court on Thursday (28Oct10), alleging studio heads violated a settlement agreement originally put in place to protect Woolrich's story, according to the Hollywood Reporter.
Famed literary agent Sheldon Abend took on the estate of movie giant Hitchcock and his film's star, James Stewart, in the 1980s after Rear Window was shown on television. Abend won the legal battle and the new lawsuit claims Disturbia breaches the case's settlement agreement by allegedly poaching parts of the original story.
The new lawsuit drops Disturbia's producer Steven Spielberg from the list of defendants, which now includes Universal and Hitchcock's estate.
Both Rear Window and Disturbia tell the story of a man who thinks he has witnessed a murder after spying on his neighbours.
