Former Cake drummer Peter Mcneal has been hit with divorce papers from his wife of 13 years.
The embattled rocker, who escaped a child molestation conviction after a Los Angeles trial last month (May12), is splitting from his partner Jill MCNeal, who has cited irreconcilable differences in court documents.
Jill is seeking sole physical custody of their two young children and joint legal custody, U.S. website Tmz.com reports.
She has also asked the court to deny MCNeal the right to any spousal support, according to papers filed in Los Angeles Superior Court.
MCNeal was accused of molesting a three-year-old girl in 2009, but a judge declared a mistrial in May after the jury was deadlocked. He is due back in court in August (12).
The musician performed with Cake from 2001 to 2004 and has also worked with Grammy winner Norah Jones.
