Incubus star CHRIS KILMORE has been granted a restraining order against the band's former DJ after he allegedly threatened to kill the rocker.
Kilmore claims he and his girlfriend, Alison Abiega, were confronted in the street last month (28Dec09) by ex-Incubus star Gavin Koppell, who was replaced in 1998.
Kilmore, who obtained his first restraining order against Koppell in 2003, claims the furious musician "asked me to fight him right there and raised his fists to me."
Koppell then demanded that Kilmore lift the previous ban, allegedly ranting, "You will get killed if you don't lift that order... People get killed in the street for that."
The rocker alleges Koppell has harassed him and the other members of Incubus for the last 11 years.
The new protection order prohibits Koppell from coming within 100 yards (300 feet) of Kilmore and his girlfriend.
A further hearing for the case is scheduled for 27 January (10).
