Michael Jackson's family will head to court in Los Angeles on Monday (29Jun09) to secure their rights to custody of the tragic superstar's three children.
The Thriller hitmaker, who died from a cardiac arrest at the age of 50 on Thursday (25Jun09), is survived by his sons 'Prince' Michael Jr., 12, and Prince Michael II, known as 'Blanket', and daughter Paris, 11.
The kids are currently being cared for by their grandmother Katherine as the family grieves the sudden loss of the King of Pop.
Reports suggested Jackson's ex-wife Debbie Rowe, who gave birth to the singer's eldest two children, would challenge his relatives for custody, despite not having any contact with them since attempting to surrender her parentage in 2005.
But the Jacksons' attorney, Londell MCMillan, insists Rowe has not been in touch and the family is seeking to protect its rights to custody with the court visit.
MCMillan is also confident there will be no custody challenge.
He says, "I don't think there will be anybody who thinks that there is someone better (than Katherine to take custody). She is a very loving host of other grandchildren."
Rowe's legal representative, Marta Almli, has also hinted the star's former nurse is not looking to interfere in the kids' care.
In a statement, Almli says, "Ms. Rowe's only thoughts at this time have been regarding the devastating loss Michael's family has suffered. Ms. Rowe requests that Michael's family, and particularly the children, be spared such harmful, sensationalist speculation and that they be able to say goodbye to their loved one in peace."
The pop legend's youngest child was born to a surrogate mother, whose identity has not been revealed.
