Ono Sues Emi For $10 Million

LATEST: Yoko Ono has successfully sued record label EMI and Capitol Records Inc for $10 million (GBP5.5 million) yesterday (18OCT06), over claims she lost royalties due from the recordings of late husband John Lennon. The lawsuit, filed in Manhattan's state Supreme Court, accuses the music giant of "wilfully and knowingly underreporting royalties" by concealing the "true use and disposition of Lennon's recordings." Ono's court papers also allege EMI and its subsidiary "intentionally and systematically rendered dishonest and grossly deficient accounting statements." A spokeswoman for EMI/Capitol, JEANNE MEYER, says, "Artists from time to time request audits of their royalty accounts. Sometimes there are differences of opinion, which is understandable given the complex nature of recording contracts." EMI will be appealing the judge's ruling. The battle between The Beatles and EMI has been raging since 1979, when the band and its company Apple Corp first accused the label of underpaying them. A settlement was reached in 1989, granting increased royalty rates, but a recent audit has revealed the deal was fraudulent. According to the band, EMI and Capitol falsely classified many copies of Beatles recordings as destroyed or damaged, before selling them in secret.
