An Usher fan is planning legal action, after accusing the R+B superstar's bodyguard of battering him backstage.

The Yeah?! singer performed a sold-out show at the Mandalay Bay Hotel in Las Vegas on 5 September (04), where Los Angeles law student BRANDON WOODARD was among the fans in the crowd.

Woodard got the opportunity to go backstage before the concert, because the friends he was with had VIP access. After the show, Brandon says he and his friends went backstage again.

He recalls, "I'm going to the bathroom and a black guy comes up to me and puts his hand on my back immediately and starts pushing me and he's asking me questions.

"I said, 'Get your hands off me,' and then he replied, 'What?', used the 'N' word and then pulled my pants so far up my backside that it bled."

Woodard claims Usher's guard was then joined by members of Mandalay Bay security, eventually landing him in hospital.

He tells American TV show CELEBRITY JUSTICE, "My right elbow was bleeding pretty bad the day it happened, and I've got a busted lip."

Woodard says that pictures show he also suffered bruises on his neck, back and chest.

The police report, however, states that Woodard merely suffered "a small cut above his left eye" - adding that his behaviour was "belligerent". Woodard was charged with battery, but none of the guards were.

Now Woodard and his mother SANDRA McBETH REYNOLDS are planning legal action.

Woodard adds, "I'm definitely going after Usher. I don't want to make it seem like I was going after Usher personally. I'm after, probably, his company, his corporation, or his tour."
